Claudia Ovalles And Rael LaPenta Discuss How The Enforcement Of The Custodial Interference Laws May Have Prevented Greyson's And Kayden's Law

  Slam the Gavel welcomes back Claudia Ovalles (Season 2, Episode 46 and Season 4, Episode 33) and Rael LaPenta (Season 4, Episode 66) to the podcast. We discussed that if the enforcement of the Custodial Interference Laws were actually followed through by law enforcement, perhaps it could have prevented Kayden's and Greyson's  Law from ever happening and these beautiful children dying. 
    Laws have been on the books for decades regarding Custodial Interference, but law enforcement does not know how to enforce them nor are they aware of them. We talked about the Writ of Habeas Corpus; is actually a recourse in law where a person can report an UNLAWFUL WITHHOLDING to a court and ask that the court order the custodian of the person, generally law enforcement, to bring the person to court to  determine if the detention is lawful. April 8th, 2023 was Custodial Interference Awareness Day.
    Parents are overwhelmed and self care is needed. However, it is good for parents to feel EMPOWERED and get involved in support groups and find SOLUTIONS to the issue of Custodial Interference. You have rights to see your child, but the other parent withholds the child from seeing you. This is CHILD PSYCHOLOGICAL ABUSE. 
    Claudia and Rael inform and  encourage parents to learn how to speak to law enforcement and the legislature. Also, to ask for the Police Policy Manual and that it's okay for a parent to report a crime instead of circumventing back to Family Court.
