Slam the Gavel podcast welcomes back Claudia Ovalles to the podcast. Claudia was last on the podcast Season 2, Episode 46 and Season 4, Episodes 33 and 86. She had great news to tell listeners that in Texas HB 969 will take affect September 1, 2023 has been passed on a municipality enacting an ordinance on creating a civil penalty for child custody orders. This will take affect September 1, 2023.
Another law, HB 3025 is in regards to removing the statute of limitations on reporting custodial interference and impacts the statutes of limitations on parental kidnapping and aggravated kidnapping. These two bills are in sync.
This took Claudia over two and -a-half years to get pushed through. Dr. Petra Deeter and Rael Lapenta had helped Claudia with this HB969 as well. Claudia was able to file it with the Senate and the House, which gives it a better chance of one of the bills going through. When collaborating with both offices, if one bill makes it through then that representative on that other side can carry it through. Claudia met with Senator Mayes Middleton and Claudia also chosen a representative that was on the committee that the bills go through and at the last minute her legislative packet had changed, because she had too many bills, but Representative Valerie Swanson walked it down the hallway to another representative,David Cook who carried it in. Claudia then got in touch with the representative from the last session and asked him to co-author it, making it a Bi-partisan bill and the bill was introduced early. This must be planned in advance.
A bill must be introduced in a hearing and some bills are prioritized above family issues. There is also CPS reform bills waiting as well as equal shared parenting.
